Fourteen Year Old Takes Car & Crashes
If a 14 yr old takes his parents' car without permission and causes wreck, will his parents’ insurance pay?
Answer: They should pay. The 14 year-old is an insured as a member of the household. So is not required to establish he was driving the vehicle with the permission of the owner as required of the second category of insured (the "omnibus" provision which would normally read "Any other person operating the vehicle with the permission of the insured.") He is a Class 1 insured as a named insured or member of the family residing in the household. In any event, to the extent of compulsory minimum limits, he is covered.
